These Terms & Conditions govern purchases made through phytocode.es. Please read them before placing an order. By submitting an order, you confirm that you have read and agree to these Terms. Mandatory consumer rights under applicable law are not limited by these Terms.

2. Scope
These Terms apply to consumer and business purchases made through this website. Provisions referring specifically to consumers apply only where the customer acts for purposes outside their trade, business or profession. Separate written terms may apply to wholesale or distributor arrangements.
3. Products and website information
We take reasonable care to present product descriptions, ingredients, quantities, usage instructions, images and prices accurately. Product packaging, colour and presentation may change where this does not materially alter the product. Always read the product label and instructions supplied with the product before use. If website information conflicts with the legally required information on the supplied product label, contact us before use.
The availability of products and promotions may change without notice. Placing an item in the cart does not reserve it.
4. Prices and taxes
Prices are displayed in euro (EUR) and include applicable VAT unless expressly stated otherwise. Delivery charges and any other applicable costs are shown before you submit the order. The final amount payable is displayed at checkout.
If an obvious pricing or description error is discovered after an order is placed, we will contact you. You may confirm the order at the correct price or cancel it for a full refund. We will not knowingly fulfil an order at an obviously incorrect price.
5. Placing an order and formation of the contract
To place an order, select the products, provide accurate billing, contact and delivery information, choose an available delivery option and payment method, review the total and submit the order. You are responsible for checking the order before submission.
An automated email acknowledging receipt of an order does not by itself guarantee acceptance. The sales contract is formed when we expressly accept the order, normally by confirming that it is being processed or dispatched. We may decline an order for legitimate reasons, including product unavailability, failed payment, suspected fraud, delivery restrictions or an obvious error. If payment has already been collected for an order we do not accept, it will be refunded.
6. Payment
The payment methods currently available are displayed at checkout. Card payments are processed through DSK Bank. Information necessary to authorise and confirm the payment is transmitted to the payment provider. Payment must be successfully authorised before fulfilment unless another arrangement is expressly offered.
You confirm that you are authorised to use the selected payment method and that the billing information supplied is accurate.
7. Delivery
Online checkout delivery is currently available only to addresses and eligible Speedy locations within Bulgaria. Orders are dispatched from Sofia. We plan to add delivery to other European countries after an international courier service is activated; until then, an order requiring delivery outside Bulgaria cannot be accepted through checkout.
Our standard delivery target is 2–5 working days after order confirmation. Working days exclude Saturdays, Sundays and Bulgarian public holidays. Delivery times are estimates and may be affected by product availability, payment checks, courier operations, incorrect customer information or events beyond our reasonable control. If a material delay occurs, we will contact you using the details supplied with the order.
Delivery charges are calculated or displayed at checkout before the order is submitted. You must provide complete and accurate delivery information and ensure that the order can be received. Risk of loss or damage passes to a consumer when the goods are physically received by the consumer or a person nominated by the consumer other than the carrier.
8. Order changes and cancellation before dispatch
Contact us immediately if you need to correct or cancel an order. We will try to accommodate the request, but changes or cancellation cannot be guaranteed after preparation or dispatch has begun. If an order has already been dispatched, the statutory withdrawal and return procedure may apply.
9. Right of withdrawal and returns
Consumers may withdraw from eligible online purchases within 14 days of delivery without giving a reason. Some products may be excluded where the legal requirements for an exception are met, including sealed goods that have been opened and cannot be returned for health-protection or hygiene reasons.
Before returning anything, contact sales1@phytocode.eu. We will provide return instructions and the applicable return address. The detailed procedure, refund rules, costs and model withdrawal form are set out in our Refund and Returns Policy.
10. Faulty, damaged or incorrect goods
Mandatory rights relating to goods that are faulty, damaged, incorrectly supplied or not in conformity with the contract remain fully applicable. Contact us with the order number and details of the issue. Where useful, include photographs of the product and packaging. We will provide instructions and the remedy required by applicable law.
11. Cosmetics, personal-care products and food supplements
Cosmetic and personal-care products are for external use unless the product label expressly states otherwise. Follow the supplied directions, warnings and storage requirements. Stop use and seek appropriate advice if an adverse reaction occurs. Individual tolerance may vary.
Food supplements must be used in accordance with the product label and must not exceed the stated recommended daily intake. They are not a substitute for a varied and balanced diet and a healthy lifestyle. Product information on the website is general information and is not medical advice. Consult a qualified healthcare professional before use if you are pregnant, breastfeeding, taking medication, receiving medical treatment, managing a diagnosed condition or unsure whether a product is suitable for you.
12. Customer accounts
You may be able to purchase as a guest or create an account. You are responsible for keeping login details confidential and for activity carried out through your account. Notify us promptly if you suspect unauthorised use. We may suspend access where reasonably necessary to protect the website, customers or our legal rights.
13. Promotional codes
Promotional codes are subject to the conditions communicated with the offer. Unless expressly stated otherwise, a code cannot be exchanged for cash, combined with another code, applied retrospectively or used after expiry. We may refuse or cancel misuse, duplication or fraudulent use of a code.
14. Intellectual property
The website, PHYTOCODE branding, product presentation, photographs, graphics, text and other content are protected by intellectual-property rights. You may use the website for personal, non-commercial shopping purposes. No content may be copied, reproduced, modified, distributed or commercially exploited without prior written permission or another lawful basis.
15. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or any mandatory consumer right. To the extent permitted by law, we are not responsible for losses caused by inaccurate information supplied by the customer, misuse contrary to product instructions, unauthorised account access resulting from the customer’s failure to protect login details, or events outside our reasonable control.
For business customers only, liability for indirect or consequential business loss, loss of profit, revenue, opportunity or data is excluded to the extent permitted by law.
16. Events beyond our control
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including transport disruption, natural events, fire, epidemic, public-authority measures, telecommunications failure, cyber incidents, labour disputes or supply interruption. We will take reasonable steps to reduce the effect and inform affected customers where appropriate.
17. Personal data
Personal data is processed as described in our Privacy Policy. Order data may be shared with payment, delivery, hosting and other service providers where necessary to provide the requested service or comply with law.
18. Governing law and disputes
These Terms are governed by Bulgarian law. If you are a consumer resident in another country, this choice does not remove any mandatory protection available to you under the law of your habitual residence.
Please contact us first so that we can try to resolve a complaint directly. Consumers may also seek assistance from the Bulgarian Commission for Consumer Protection at kzp.bg or use another competent alternative dispute-resolution body. Disputes may be brought before the courts competent under applicable law.
19. Changes to these Terms
We may update these Terms to reflect changes in law, the website or our services. The version in force when an order is placed applies to that order unless a mandatory legal change requires otherwise.
